 b) State FSSAI License:

  • Mandatory for businesses with annual revenues between ₹12 lakhs and Rs. 20 crores.
  • Meant for the middle end food business where online cloud kitchens, food delivery services, operate in a single state.
  • Issued from the state food authority.

 c) Central FSSAI License:

  • Required by large e-commerce food companies, whose turnover exceeds ₹20 crore.
  • These are needed by food aggregators such as Swiggy, Zomato, Amazon Pantry, and BigBasket.
  • Applicable to businesses that engage in import/export activities, interstate operations, or that have food processing facilities.
  • Issued by the Central Authority of FSSAI.

2. Gather the Required Documents

Companies wanting to apply for a particular license must gather all the required documents associated with that specific license type. For applying for an e-commerce FSSAI license, the documents required are:

a) Proof of Business Registration and Identification:

– Certificate for company registration (Incorporation for private limited, Limited Liability Partnership, or Partnership deed for partnerships).

– Business PAN card or Owner PAN card.

– For proprietors, partners, and directors, proof of identity like Aadhaar, voter’s ID, or passport.

b) Address Proof of Business Premises:

– Rental agreement and No Objection Certificate (NOC) from the landlord (for rented properties).

– Utility bills such as electricity or water bills, or property tax receipts (if applicable).

c) Food Safety Compliance and Business Information:

– Outline the Food Safety Management System (FSMS) Plan describing the hygienic and quality control measures in place.

– A list of food products or categories that will be offered for sale.

– Information regarding methods that will be used for storage and transportation (if applicable).

– A declaration by the business owner that states conformity with food safety regulations.

d) Documents Related to the E-Commerce Platform:

– Details about website or application along with URL and description.

– Agreements with food vendors or suppliers: For marketplaces, contracts need to be established between restaurants or suppliers.

GST registration certificate (if applicable).

e) Additional Documents for Central License:

– Signed FSSAI Form-B, completely filled.

– Layout plan or facility blueprint (if applicable).

– Water testing report by an FSSAI approved laboratory, when applicable.

3. Submission of the Online Application through FoSCoS Portal

The application for FSSAI license shall be submitted by online mode through the Food Safety Compliance System (FoSCoS) Portal, which may be accessed at https://foscos.fssai.gov.in

Online application procedure:

(i) Visit FoSCoS Portal https://foscos.fssai.gov.in

(ii) Click on Apply for License/Registration and select the appropriate category, i.e., Basic, State, or Central.

(iii) Fill the application form with information about the business, type of food, area of operation, and e-commerce, if applicable.

(iv) Upload the required documents, ensuring that all files are in an appropriate format.

(v) Make the payment of the application fee:

  • Basic registration shall be ₹100 per annum;
  • State license will be charged from ₹2000 to ₹5000 per annum;
  • Central license is charged at ₹7500 per annum.

(vi) Submit the application and note the reference number. After the submission, an Application Reference Number (ARN) will be generated to trace the application.

4. Inspection and Verification by FSSAI Authorities

  • Review of Application: FSSAI authorities shall review online submitted documents and business information.
  • Inspection: FSSAI may carry out inspection by its officers on State and Central Licenses of the premises used for the business, carrying out storage of food, or food preparation.
  • Corrections and Clarifications: In case of discrepancies, FSSAI may ask for additional documents or for the application to be amended.

5. Approval and Issuance of FSSAI Licence

  • Approval Process: Within 30-60 days, FSSAI grants the license if all standards are completed. Obtain FSSAI License: Once approved, the license can be downloaded from the FoSCoS portal.
  • Validity and Renewal: The FSSAI license is valid for 1-5 years based on the choice of the applicant; renewal should happen at least 30 days before the expiry date.

6. Post License Compliance and Display Conditions

Display the FSSAI logo and license number on e-commerce websites, mobile apps, and invoices. Food aggregators are required to check the existence of an FSSAI license for all listed sellers.
